2005 Summary of Board actions

Kansas City, MO

  • The board voted to void the district 5 election, Noah Goddard would continue in his seat as director per Missouri Law regarding NFP's. The newly created seat would remain vacant. The two seats will be re-voted in the next general election for the remainder of the term. (See subsequent action below)
  • Noah Goddard was found to have conduct detrimental to the association.
  • Noah Goddard's individual membership was suspended for a period of 5 years.
  • Wendel R. Wardell, Jr.'s request for membership is permanently denied and he is denied any non-member services from ADGA.
  • The Board voted to not accept the resolution proposed regarding the complaint against the memberships of Bruce and Nancy Nickel and Marvine Harris and Julie Einsendel. A hearing panel will now do a record review of the standing committee resolution in compliance with our complaint process.
  • An Ad Hoc Committee to recommend a Nigerian Dwarf measuring device, possibly being offered for sale by ADGA.
  • Board approved of establishing a retainer with John Ruth, attorney from MO.
  • B, p 133, 5, d change in wording in bold:

One announcing teller (employees of the Election CPA) will call out the vote on the ballot. Two tellers will record the ….. (strike- A second teller will record the votes, as called, on a second tally sheet.) One recording teller may also be the announcing teller.

  • Board approved of researching the feasibility of providing services to other organizations. Contract(s) for services would be entered into only upon board approval.
  • GB, page 13, IV, C. 3. Add Postal Ballot …Votes may be submitted by postal mail or electronic mail (facsimile or e-mail)
  • Adopted a new election ballot. The ballot will have several new safe guards including being on an 8 ˝ X 11 paper, the signature stub will have preprinted membership name and a randomly selected bar code, paper will have a Microprint lines and a thermochromic oval (pink dot), and Dupliguard background,
  • The board approved of the following proposed Constitutional Amendments pending approval of the C,B, L Committee for form and legality and then submission to the membership:
    • 1) The authority of EC to hire legal counsel
    • 2) Any member who files a lawsuit against ADGA and the suit is dismissed or ADGA prevails, that member will reimburse ADGA for legal fees.
    • 3) If ADGA takes legal action against a member and prevails the member is responsible for ADGA's legal expenses.
    • 4) If a director files a lawsuit against ADGA they will not receive information regarding the litigation due to the attorney/client privilege.
    • 5) Revised the Executive session statement to include litigation and personnel matters.
  • Approved of a new confidentiality statement
  • Approved of a membership renewal in the International Goat Association at the Institutional level for a cost of $500. A letter of thanks is to be sent to George Haenlein for his previous gift of this membership.

ADGA Research Foundation:
Financial report given of funds available. No action taken.

Advanced Judges:
Report given of Advanced Judges seminar held on Saturday. Committee approved of extending 4 Advanced Judges license until the next seminar do to health reasons (3) and scheduling (1).

Annual Meeting:
Conventions are already scheduled thru 2010. No action taken.

Artificial Insemination:
No action

Awards Committee:
Accepted added wording to the GB, page 4. All nominations for any ADGA Award shall be submitted with full, supporting detailed written documentation. If approved by the Awards Committee this documentation will be provided to each director. -The Awards Committee received a nomination for the Award of Merit. It is given to Gary Moore for his outstanding service to ADGA over the last year.

Breed Standards:
Page 111, Lamancha, add 3. The ear is to be measured with a rigid measure placed firmly against the head at the base of the ear, but neither pulled or stretched. Natural folds and creases of the ear are to be unaltered during measurement. Referred suggested changes to the Breed Standards back to committee. Advice was given to committee to work with the registration committee on wording and placement.

C,B,L:
No Action.

  • Referred to committee to review page 3, Article VII, Elections, #4 …. The mailing of a membership directory to each individual member. Consider mailing only one membership directory to each address, or it be available on-line.
  • Referred to committee to investigate establishing different levels of memberships and the voting rights of each level. Types of levels to consider Individual, Group, Corporate, Joint, etc.
  • Referred to committee to review the proxy bid relevance.

DNA Committee:
The board accepted the recommendation from the committee to accept the contract from Veterinary Genetics Laboratory at the University of California at Davis to provide DNA typing services for ADGA effective immediately.

Finance Committee:

  • Approved of an increase of registration fees of $1.00 and give a discount of $1.00 during the period from September 1 to March 31st. No change in revenue.
  • Approved of a wage increase for staff of up to 4% to be dispersed by the Association Manager for an average increase of 2.5%.
  • Increase mileage reimbursement on the Standard Committee Expense Guideline to the published IRS reimbursement amount. The current IRS rate is 48.5 cents per mile.
  • Changed the early discount for membership renewal from $17.50 to $20.00 effective January 1, 2006.
  • The News & Events will be reduced to approximately ˝ its present size. Also directed to seek other ways to decrease cost such as paper weight, and less color. Projected savings of $15,000.
  • Approved of publishing the performance volumes in a searchable/printable CD only. The CD will be sent free to those participating in both DHI/LA. The CD would be available for purchase will all breeds for $20.
  • Approved of $2,000 phone recording system for quality assurance purposes in the ADGA office.
  • Approved of the final budget with a projected 11,700.00 loss.

Government and International Liaison:
No Action.
Reported on status of national animal ID.

History Committee:
No action taken.
Update given to the board about the records now located at the National Archive Library.

IM:
Approved the new position of the Information Services and Systems Manager with plans to implement a members only website, Electronic communications, account access, on-line registrations, transfers and service memos.

Approved of a Web Based Privacy Statement after review of legal sufficiency of the MO attorney.

Judges Committee:

  • Based on a complaint received by the Judges Committee and upon recommendation from the committee, the Board voted to revoke Marshall Binkley's judges license immediately and that he be prohibited from ever holding an ADGA judging license.
  • Added wording to the GB page 107, XIV, G 3 Said notice shall be mailed at least 30 days prior to said hearing by certified mail, return receipt requested.

Judges TC Committee:
Approved to insert into the GB to Article XIV, G, new item 6. Any letter of concern/reprimand for misconduct or incompetence referred by the Official Judges Committee or failure to follow correct procedure and appropriate supervision of ROA's referred by the Official Shows Committee shall be listed as a strike against said judge, contingent upon approval by the BOD. When three strikes are accumulated, with a ten year limit from the 1st date of occurrence, said judge will have their licensed revoked. If he/she wishes to judge again, the first license will be as an apprentice.

Linear Appraisal:

  • Approved adding miscellaneous code 81: Exceeds maximum height allowed for breed.
  • Referred to committee to establish a quality assurance program.
  • Committee to reconsider not allowing a first freshener to score excellent.
  • Referred to committee to investigate appraising animals in Canada.

Linear Appraisal Long Range:
Add to the GB page 62, new H. Verification Procedures for Final Scores Exceeding 93. A verification process was approved for animals that appraise above a final score of 93.

Membership:

  • Accepted changing all references to 'Junior" Members to "Youth" Members in the GB. Pages 9, 43, 92, 116, 117, 125, 127, and 128.
  • Accepted proposal to create a sub committee for the purpose of dealing with look alike/sound alike herd name problems that the office can not resolve.
  • Voted to continue to sell the Membership Directory to non-members. The fee for the Membership Directory for non-members was raised to $30.00.
  • The New Membership/Renewal Forms will have the following statement "I verify that the information submitted is correct. I understand that misrepresentation will cause the forfeit of my membership." A signature is required to the form. If the membership/renewal form is submitted on line, the same statement would apply with a check off box added instead of a signature.
  • Voted to publish a member's mailing address in the Membership Directory, but require a physical address also for office use, if it is different from the mailing address.
  • Voted to add to the second paragraph on page 127 of the GB under Authorized Signatures the following: "Signature cards are to be used for the purpose of signing registrations and transfers. They may be used to vote the ballot of a corporation, association, business, family, or partnership, BUT NOT AN INDIVIDUAL'S BALLOT."
  • Referred to the committee : To look at different levels of memberships. For example corporate, joint, individual, etc.

National Show:
Received the final income/expense for the 2005 Show. National Show Long Range: Board approved of maximum entry, pen, etc fees for 2006 National Show. The fees may be lowered if a grant is received from the State of Indiana.

Production Testing:

  • Renewed our contract with California DHI quality assurance for a period of 3 years. The total cost was $9,000 over 3 years.
  • Change to GB P 47, IX, A, 29. add language in bold: ADGA will accept milk records from the Canadian Goat Society (CGS) and lactation records made in the DHIR program of the American Goat Society (AGS) and any other registries approved by ADGA on dual registered animals after application to enroll and acceptance in ADGA program provided documentation is provided that the records were made under test conditions allowable under (and in full compliance with) ADGA DHIR rules.
  • Add bold wording to the GB pg 43, IX, A, 5 Only Field Service Units, Laboratories, Meter Centers and Dairy Council on Dairy Cattle Breeding or ADGA can be used by participating herds in ADGA's DHIR programs and one-day milking competition.
  • Approved Performance Programs tri-fold brochure developed by Performance Program Coordinator with input from related committees. This will be available on-line. A price estimate for printing will be obtained and approved by the EC before printing.

Products:
Approved a budge of $7,000 for 2006 that would include the booth at the World Dairy Expo.

Publicity/Promotions/Educational:

  • Approved of discontinuing the trading card project due to lack of revenue.
  • 3 new logo designs from 2 artists were submitted to the board. The board referred this back to committee for submission of further logo designs.
  • Referred to committee to investigate possibility of accepting advertising in the News & Events.

Registration:

  • Removed the word "dairy" from the identification certificate for wethers.
  • Page 30, section A new rule 8 be added and the rest moved down When a doe is rebred within ten days of previous breeding, either through live service or through artificial insemination, to a different buck than the original breeding, the resulting kids must only be eligible for the Experimental herd book, providing they otherwise meet the requirements of the Experimental herd book, with both sires listed on the application registration, until such time that parental verification through DNA has been completed.
  • Approved changing page 33 that rules D2 and D3 be changed to say "rules 2 thru 11" o GB, page 40 eliminate rule K6 and renumber the rest.

Scholarships:
No Action taken.

Shows:

  • All breed club names will be removed from ADGA rosettes.
  • GB, pg 77, XII, K, 8. Replace sentence "subtract the number of dry milkers from the number of does in milk." With the following sentence "Subtract the number of dry milkers from the total number of Sr. Does judged."
  • GB, pg 75, XII, J. 8 Add the following sentence "If the GCH animal also qualifies for the Superior Genetics Award, it is entitled to be the SGCH designation."
  • Page 70,GB, XII, C, 14 add the following wording "ADGA licensed judges are under no obligation to approve or sign Reports of Awards or any other documents for any other registry or association other than ADGA."
  • GB, page 71, E, 13, H add SGCH.
  • Referred to committee to consider making an AOP class on the day of the show. Chris Strickland to supply CGS rules as a reference.

To qualify for:
Superior Genetics (SG):

  • The animal must be in the top 15% (85th percentile ranking or higher) of their breed according to the Production/Type Index (PTI) ranking at least once during the life of the animals. The ranking may be either in one area (PTI 2:1 or PTI 1:2) or in both areas.
Superior Grand Champion (SGCH):
  • The animal must earn both the SG designation and earn a permanent championship. The awards may be earned in separate years and in any order to qualify.

ADGA Genetic Awards Program
For animals earning their permanent championship in 2005 and beginning with the 2005 yield evaluation update:

If the certificate is received within 60 days from the date of owner notification (which shall occur twice per year, once after the completion of the yield evaluations, and again after the completion of type evaluations), ADGA will revise the certificate free of charge to show the SG or SGCH designation.

If the certificate is returned more than 60 days after the date of owner notification, ADGA shall charge a normal Revision of Certificate of Registration/Recordation fee as outlined in the current ADGA Schedule of Rates for both members and non-members.

Awards earned on the basis of evaluations prior to July 2005 shall be required to pay the current normal Revision to Certificate of Registration/Recordation fee as currently outlined in the ADGA Schedule of Rates for both members and non-members, for those registration certificates to be revised.

Amend Article XI, Sire Development Program, last paragraph: Old wording: We will inform the industry about bucks who have qualified for the ADGA-SDP in two ways: 1. Inform the owner by letter and 2. publish a list of qualifying bucks periodically.

New Wording: ADGA will inform the industry about bucks who have qualified for the ADGA-SDP in two ways: 1. Inform the owner by letter and 2. Publish an annual list of qualifying buck.

Spotlight Sale:
No Action taken. Report of financial statement from the 2004 sale.

Trade & Arbitration:
Page 123, XX, B, 1 add "and the form must be signed by the Complainant(s)" so the sentence will read: "The dispute shall be submitted in writing on the form prepared by the Committee and the form must be signed by the Complainant(s).

Type Committee:
Approved of the committee to start the bid process to secure an artist to provide True Type illustrations of the 8 ADGA recognized dairy breeds. A $500 deposit was approved to secure the bid of the artist. The EC will then approve of the total amount of the project.

Youth Activities National Show/Annual Meeting:
Approved of raising the Youth Show Judges fees to $150 from $100.

Approved the "Requirements for ADGA Youth Representative and Alternate" pending review of our attorney.

Approved of funding for the Alternate Youth Rep to the National Show. ADGA will pay ˝ of the travel and lodging expenses incurred. No meal per diem will be provided.

Youth/4-H/FFA: No committee members were present to give the report. The President/EC to contact the chair for clarification of several items.
